  • To be eligible for the 13th month pay, an employee must have worked for a minimum of one month. 
  • Employees get this 13th month pay regardless of their position, designation or employment status. This includes full time employees, part time employees, probationary employees or seasonal employees. 
  • Whether an employee is paid on a daily, monthly basis, they are entitled to get 13th Monthly Pay. 
  • This benefit is specifically for employees who work in the private sector. 
  • Employees who resign or separate from a company during the year are still qualified for proportionate 13th month pay based on the months they have worked. 
  • Female employees who are on maternity leave, their leave counts toward the computation of the 13th monthly pay.

  • 13th Monthly Pay Computation: If an employee worked for a full 12 months in a year then their 13th monthly pay is calculated as: Total Basic Salary of full year ÷ 12. But if an employee does not work for a full 12 months in a year then their 13th Monthly Pay is calculated on a pro rata basis. 
  • Timing of the 13th Month Pay: Under current rules, employers must give the 13th monthly pay on or prior to 24th December of each year. This deadline applies to all employers. For 13th Monthly Pay 2026, the deadline is 24th December 2026. 
  • Submission of Compliance Report: All employers must submit a report of compliance to DOLE online via their DOLE Establishment Report System. This report should be submitted by 15th January of each year. The 2026 Compliance Report must be submitted by 15th January 2027. This report includes:
    • Company Name & Address 
    • Principal Product of Business 
    • Total Number of Employees Benefited from 13th Monthly Pay 
    • Total Number of Employees Working in the Company
